BAGHDAD, Iraq โ Iraq's Federal Court invalidated a contract for a traffic monitoring and violation system on Tuesday, ruling that collecting fees from citizens without clear legal authorization is unlawful.
The case (24/ฤฐstinaf Kurulu/Devredilen/2025, dated January 28, 2025) centered on a contract for operating a system that tracks traffic violations. The contract stipulated additional charges beyond service fees and statutory fines.
The court emphasized that no fees or penalties can be collected outside the limits established by law. It stated that traffic laws clearly specify which authorities can impose penalties, the amounts involved, and the procedures for collection.
The ruling also declared that contracts violating the law are invalid and cannot serve as a basis for compensation claims. The court upheld the dismissal of the appeal and ordered the appellant to cover appeal costs.
